1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("Driver Partner," "you," or "your") and DriveDa ("Company," "we," "our," or "us") governing your use of the DriveDa Partner mobile application and related services (collectively, the "Service").
By registering for and/or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.
2. Service Description
DriveDa is a technology platform that connects professional drivers with customers who require driving services for their personal vehicles. As a Driver Partner, you will:
- Drive customers' personal vehicles to their desired destinations
- Provide professional driving services as an independent contractor
- Maintain high standards of service quality and safety

DriveDa does NOT guarantee, promise, or assure any minimum number of rides, bookings, or earnings to Driver Partners.
- Ride availability depends entirely on customer demand, location, time, and market conditions
- Being registered on DriveDa does NOT entitle you to any rides
- Premium subscription does NOT guarantee any minimum rides or earnings
- Subscription benefits (0% commission, priority) only apply when rides are available and assigned
- DriveDa is not responsible if you do not receive any ride requests
- Past performance or earnings are not indicators of future earnings
By registering, you acknowledge and accept that DriveDa makes NO promises regarding ride availability, frequency, or income potential.
3. Registration & Fees
FREE Zero Registration Fee
DriveDa does NOT charge any registration fee. Join our platform completely free of cost. No hidden charges, no signup fees, no monthly mandatory fees.
3.1 Required Documents
- Valid Driving License: LMV/Transport license appropriate for vehicle types
- Aadhaar Card: Front and back (for identity verification)
- PAN Card: For tax compliance
- Profile Photo: Clear, recent passport-size photograph
- Address Proof: Valid proof of current residence
- Police Verification: Optional but recommended
3.2 Eligibility Requirements
- Minimum age: 25 years
- Minimum driving experience: 5-6 years in city conditions
- Clean driving record with no major violations
- No criminal record or pending criminal cases
- Legally authorized to work in India
4. Commission & Payment Structure
4.1 Standard Commission (No Subscription)

SUBSCRIPTION DISCLAIMER
Premium subscription does NOT guarantee any minimum number of rides, bookings, or earnings.
- Subscription only provides benefits like 0% commission and priority WHEN rides are available
- "Priority allocation" means you are given preference over non-subscribers when multiple drivers are available - it does NOT create rides where none exist
- If there is no customer demand in your area, subscription will not generate rides
- Subscription fees are non-refundable, regardless of rides received
- DriveDa reserves the right to modify subscription benefits with prior notice
- You may cancel subscription anytime, but no pro-rata refunds will be provided
Please evaluate your expected ride volume before subscribing. Subscription is most beneficial for drivers who already receive regular bookings and want to reduce commission.
4.4 Payment Schedule - Choose Your Preference

6. Penalties & Fines
To maintain service quality and protect customers, the following penalties may apply:
6.1 Driver Penalties

6.2 Driver Protection - Customer Cancellation Compensation
We protect our drivers! If a customer cancels after you've started traveling:

We will NOT leave you stranded or unpaid for customer mistakes.
6.3 Penalty Appeal Process
We believe in fair treatment. If you believe a penalty was unfairly applied:
- Raise a dispute within 48 hours via the app (Profile → Help → Dispute Penalty)
- Provide evidence (screenshots, photos, GPS data)
- Our team will review within 3 business days
- Penalty reversed if found unjustified + apology
7. Insurance & Safety Benefits NEW
DriveDa Driver Protection Plan
All active Driver Partners are covered under our protection plan at no extra cost:

8. Driver Partner Obligations
8.1 Service Standards
- Provide professional, courteous service to all customers
- Arrive on time for scheduled bookings (10-minute grace period)
- Drive safely and follow all traffic rules
- Keep your profile and documents up to date
- Maintain a professional appearance
- Keep mobile phone charged and app active during trips
- Communicate proactively if running late
8.2 Dress Code
- Clean, neat casual attire
- Closed shoes preferred (no bathroom slippers)
- DriveDa branded t-shirt - Optional, NOT mandatory
Note: Unlike some competitors, we do NOT fine drivers for dress code. We trust you to be professional.
8.3 Prohibited Conduct
You must NOT:
- Drive under the influence of alcohol or drugs
- Use mobile phones while driving (except hands-free navigation)
- Engage in reckless or dangerous driving
- Harass, discriminate against, or harm customers
- Cancel bookings without valid reason after acceptance
- Share customer personal information with third parties
- Solicit customers for off-platform bookings
- Misrepresent your identity or qualifications
- Smoke in customer's vehicle
- Make unauthorized stops during trips
- Overcharge or demand cash beyond app fare
9. Booking & Cancellation Policy
9.1 Accepting Bookings
- You may accept or decline booking requests freely
- Once accepted, you are committed to completing the booking
- Maintain acceptance rate above 60% for priority bookings
- Response time: Accept/decline within 3 minutes
9.2 Driver Cancellation Policy

9.3 Valid Cancellation Reasons (No Penalty)

- Safety concerns at pickup location
- Customer requested illegal activity
- Natural disaster or road closure
- Family emergency
10. Ratings & Performance
10.1 Rating System
Customers rate your service after each trip (1-5 stars). Your rating affects booking priority.
10.2 Rating Thresholds

11. Operating Hours
DriveDa operates 24 hours, 7 days a week.
- Go online/offline anytime - complete flexibility
- No minimum hours requirement
- Late night trips (10 PM - 6 AM): Additional safety verification
- We will NOT restrict you from driving at any hour or leave you stranded
- 24/7 emergency support available
12. Account Suspension & Termination
12.1 Grounds for Suspension
- Violation of these Terms
- Rating falls below 3.5 stars (after warnings)
- Multiple verified customer complaints
- Document expiry (7-day grace period to update)
- Fraudulent activity
- Cancellation rate exceeds 40%
12.2 Termination
Either party may terminate this agreement. Upon termination:
- Platform access revoked
- Pending earnings paid within 7 business days
- Outstanding penalties deducted from final payout
- You may reapply after 90 days (except permanent bans)
13. Dispute Resolution
- Contact support team first (48-hour response guaranteed)
- If unresolved, escalate to Driver Grievance Officer
- If still unresolved, mediation under Arbitration Act, 1996

14. Modifications to Terms & Policies
RIGHT TO MODIFY TERMS & POLICIES
DriveDa reserves the absolute and unconditional right to modify, amend, update, or change any part of these Terms of Service, Privacy Policy, commission structures, subscription plans, payment schedules, penalties, and any other policies at any time.
14.1 Types of Changes
DriveDa may modify without limitation:
- Commission rates and payment structures
- Subscription plans, pricing, and benefits
- Eligibility requirements for Driver Partners
- Penalty structures and amounts
- Booking allocation algorithms and priority systems
- Service areas and availability
- Insurance and protection coverage
- Referral programs and bonuses
- Rating systems and performance metrics
- Privacy and data handling practices
- Any other terms, features, or policies
14.2 Notice of Changes
We will provide notice of material changes via one or more of the following:
- In-app notification
- WhatsApp message
- Email to registered address
- SMS notification
- Update to this Terms page
14.3 Acceptance of Changes
- For material changes, a notice period of 7 days will typically be provided
- For urgent changes (security, legal compliance, fraud prevention), changes may be effective immediately
- Continued use of the Service after any change constitutes your acceptance of the modified terms
- If you do not agree with any changes, your only recourse is to discontinue use of the Service
- DriveDa is not obligated to grandfather existing users into old terms
It is your responsibility to review these Terms periodically. The "Last Updated" date at the top of this page indicates when changes were last made.
15. Limitation of Liability
15.1 Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTY OF ANY KIND.
DriveDa expressly disclaims all warranties, whether express, implied, or statutory, including but not limited to:
- Warranties of merchantability or fitness for a particular purpose
- Warranties regarding ride availability or frequency
- Warranties regarding earning potential or income
- Warranties of uninterrupted or error-free service
- Warranties regarding customer behavior or payment
15.2 Limitation of Damages
- DriveDa shall NOT be liable for any indirect, incidental, special, consequential, or punitive damages
- DriveDa shall NOT be liable for loss of profits, earnings, revenue, or business opportunities
- DriveDa shall NOT be liable for emotional distress or disappointment from lack of rides
- Maximum aggregate liability = commission earned from past 3 months OR ₹5,000, whichever is lower
15.3 Driver Responsibilities
- Customer's vehicle insurance covers trip accidents - Driver responsible for any exclusions
- All traffic violations, challans, and fines during trips = Driver's sole responsibility
- Personal injury claims during off-platform activities = not covered
- Driver must maintain valid license and insurance at all times
15.4 Indemnification
You agree to indemnify and hold DriveDa harmless from any claims, damages, losses, or expenses arising from:
- Your violation of these Terms
- Your driving conduct or negligence
- Claims by customers or third parties
- Accidents, damage, or injuries during trips
- Your violation of any laws or regulations
